Right to File a Claim and Return of Non-Conforming Products
1. Mediagear OÜ is liable for non-conformity and defects in products in accordance with the Law of Obligations; the period for filing claims is 1 year for private individuals and 6 months for legal entities, starting from the date of delivery of the products.
2. The buyer must notify the seller of any non-conformity with the terms of the contract within a reasonable time after becoming aware of, or having reason to become aware of, such non-conformity.
3. Mediagear OÜ is not liable for:
1) Deterioration or damage to the product caused by the buyer/consumer.
2) Defects resulting from improper use of the product.
3) Normal physical wear and tear of the product under normal use.
4. In the event of non-conformity or a defect in the product, you have the right to request replacement of the product with one that conforms to the requirements and is free of defects, or to cancel the order and return the non-conforming product at Mediagear OÜ’s expense.
5. If a claim is filed within the first six months after delivery of the item to the buyer, Mediagear OÜ will bear the costs associated with repairing or replacing the item. During the following six months, Mediagear OÜ will bear these costs only if the claim was justified.
6. If you return a product that does not meet the requirements, the amount paid for the product (including shipping costs) will be refunded to the bank account you specified no later than 14 days after we receive notice of your withdrawal from the order and your request to return the product.
7. In addition to the right to file a claim, you also have other rights under the law to seek legal remedies.
